Tracea Sàrl

1 – Scope

Bicycle hire services are provided by Tracea Sàrl (CHE-452.942.213). The General Terms and Conditions of Hire form an integral part of the hire agreement. By signing this agreement, the Hirer confirms that they have read these Terms and Conditions of Hire and accept them unconditionally.

2 – Contractual relationships

The contract is entered into between the customer (the Tenant) and Tracea Sàrl (the Landlord).

3 – Minimum age requirement / driving licence

Children and young people under the age of 16 must be accompanied by an adult. Children and young people under the age of 16 who are not accompanied by an adult may only hire a bike with the written consent of their parents or guardian. The legal minimum age for riding an e-bike with assistance up to a maximum of 25 km/h is 16 years, or 14 years for holders of a moped licence for vehicles under 50 cm³.

4 – Collecting the bike

The hirer shall take delivery of the item in good working order and clean. They are required to check its condition immediately and carefully, in particular that of the brakes, and to report any fault or defect to the hire company without delay. Failing this, the hirer shall be deemed to accept responsibility for any faults or defects present at the time the bicycle is returned.

5 – Returning the bike

The Hirer undertakes to return the bicycle to the Lesser at the end of the hire period specified in the hire agreement, at the location indicated in the hire agreement and during the opening hours of the St-Cergue Tourist Office. The rental fee for items returned late or in disarray, as well as any resulting costs, shall be borne by the Hirer. The bicycle and all accessories provided by the Lessor, such as keys, cycling helmets and other items, must be returned to the Lessor when the bicycle is returned, in their entirety and in perfect condition. If the Hirer has lost or damaged the bicycle or any accessory, they will be charged for it.

6 – Liability and insurance

Insurance is the responsibility of the Hirer. By signing the hire agreement, the Hirer declares that they hold personal liability insurance and are therefore adequately covered for the risks associated with travelling by bicycle or e-bike. The liability cover also extends to the costs of damage, such as survey costs, loss of value or costs relating to loss of rental income.

The Tenant is obliged to notify the Landlord of any damage or loss that has occurred.

The Tenant is liable for any damage sustained by the rented property and its accessories during the tenancy period and resulting from falls, acts of vandalism, natural causes, mishandling, damage caused during transport, and the inappropriate or unauthorised use of these items. The costs relating to minor damage or the loss of equipment will be invoiced directly to the customer by Tracea Sàrl.

The Hirer is liable for any loss or theft of the hired item or accessories during the hire period. In principle, the bicycle must always be insured. Any loss will be charged to the Hirer at the cost of a replacement item.

If the Hirer hands the bicycle over to a third party, the Hirer is, in principle, liable for any damage or consequential damage caused by that third party.

7 – Damage, theft and loss

The Hirer declares that they hold personal liability insurance and are therefore adequately covered for the risks associated with travelling by bicycle or e-bike. The liability cover also extends to the costs of damage, such as survey costs, loss of value or costs relating to loss of hire.

8 – Use / Prohibitions

The Hirer undertakes to comply with the Highway Code and to use the bicycle appropriately and with due care. The Hirer is liable for any damage resulting from negligence or improper use of the hired item and caused to that item or to a third party’s property.

9 – Cancellation terms and conditions

A confirmed online booking may be cancelled or amended free of charge up to 72 hours before the start of the hire period. If cancelled less than 72 hours before the start of the hire period, no full or partial refund will be payable.

10 – Applicable law and jurisdiction

This contract is governed by Swiss law. The place of jurisdiction is Nyon (VD).
